Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Prismo ("we", "us", "our") governing your use of the Prismo medical‑report analysis application and related services (the "App"). Please read them together with our Privacy Policy and our Medical Disclaimer, which are incorporated into these Terms by reference.

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service — Informational Only, Not Medical Advice

The App provides consumer health information for educational purposes only. It is not a medical device, does not provide a diagnosis, does not prescribe treatment, and is not a substitute for professional medical advice. Always consult a qualified healthcare professional before making any medical decision. See our Medical Disclaimer.

Interpretations, summaries, and images in the App are generated by artificial intelligence (AI) and may be incomplete or incorrect. You are responsible for any decision you make based on the App, and you should independently verify important information with a clinician.

2. Eligibility and Family Profiles

  • You must be an adult of legal age in your jurisdiction to create an account.
  • The App uses a parent‑managed model: an adult account holder may add a Profile for a minor (for example, a child) and upload that minor's reports. The minor has no independent account or login.
  • By adding a minor Profile you confirm that you are the parent or legal guardian, are of legal age, and consent to processing that minor's data.
  • The App is not offered in mainland China.

3. Accounts and Security

  • You may use the App as a guest, or sign in with email one‑time password, Apple, or Google.
  • You are responsible for safeguarding access to your account and for all activity under it.
  • You agree to provide accurate information and to keep it up to date.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe are used for fraud or abuse.

4. Acceptable Use

You agree not to:

  • use the App for any unlawful purpose or in violation of any applicable law;
  • upload content you have no right to upload, or another person's medical reports without authorization;
  • attempt to reverse engineer, scrape, overload, or circumvent the security, rate limits, or usage allowances of the App;
  • misuse the App to provide medical services to third parties or to make clinical decisions for others; or
  • interfere with the operation of the App or other users' use of it.

5. Your Content

  • You retain ownership of the reports and other content you upload ("Your Content").
  • You grant us a limited, non‑exclusive license to process Your Content solely to provide the App's features to you (including de‑identified processing by our AI providers as described in the Privacy Policy).
  • You are responsible for the legality of Your Content and for having the right to upload it.
  • You may delete Your Content or your account at any time; deletion is handled as described in the Privacy Policy.

6. Purchases, Subscriptions, and Credits

  • The App offers a free tier, auto‑renewing subscriptions, and consumable purchases ("credits" and bundle passes). Prices are shown in the App and charged by the applicable app store.
  • Billing is handled by Apple (StoreKit) or Google (Play Billing). Payment, renewal, and store‑level refunds are governed by the store's terms; we do not process your payment card.
  • Auto‑renewal: subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period, through your app store account settings.
  • Consumables: purchased credits do not expire and are not transferable between accounts. Subscription benefits apply only while the subscription is active.
  • We do not offer free trials. Free allowances are granted per account and per device to prevent abuse, and may be adjusted over time.
  • We charge only for a successfully completed analysis; if an analysis fails, the corresponding allowance is released. Except where required by law or store policy, fees already charged are non‑refundable.

7. Intellectual Property

The App, including its software, design, text, and branding (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to use the App beyond the license granted here. We grant you a limited, personal, non‑transferable, revocable license to use the App for your own non‑commercial use.

8. Third‑Party Services

The App relies on third‑party providers (including Anthropic, Google, and Amazon Web Services) to operate. Your use of the App may also be subject to the terms of Apple or Google as your app store. We are not responsible for third‑party services we do not control.

9. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant that the App will be uninterrupted, error‑free, or that any interpretation is accurate or complete.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the App or any interpretation it produces. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from Your Content, your use of the App, or your violation of these Terms or of any applicable law, except to the extent caused by us.

12. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for legal, security, or operational reasons. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

13. Changes to the Service or These Terms

We may modify the App or these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, notify you in the App. Continued use of the App after changes take effect means you accept the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict‑of‑laws rules, and subject to any mandatory consumer‑protection rights you have in your country of residence. We will try to resolve disputes informally first; please contact us before bringing a formal claim.
